Section 78 BNS — Stalking
Any man who:
- Follows a woman and contacts or attempts to contact her to foster personal interaction repeatedly despite a clear indication of disinterest, or
- Monitors the use by a woman of the internet, email, or any other form of electronic communication
…commits the offence of stalking.
Punishment

| Second or subsequent | Up to 5 years + fine |
This is a cognizable and non-bailable offence.
Exceptions
Stalking is NOT an offence if it was:
- Pursued for the purpose of preventing or detecting crime
- Done under any law or legal authority
- Reasonable and justified in the particular circumstances
Cyber Stalking
Monitoring someone’s social media, emails, or location data without consent is explicitly covered. Screenshots, tracking apps, and repeated unwanted messages all qualify.
